TERMS AND CONDITIONS, WAIVER AND RELEASE
By enrolling in training with RealDefence Krav Maga (“RealDefence”), you agree to the following terms.
TC1. Acknowledgment of Recreational Service
1.1 RealDefence provides martial arts, self-defence and fitness instruction which constitutes a “recreational service” for the purposes of section 139A of the Competition and Consumer Act 2010.
1.2 Training in Krav Maga is a dangerous recreational activity within the meaning of the Civil Liability Act 2003 and involves significant risk of physical harm.
TC2. Acknowledgment and Assumption of Risk
2.1 I acknowledge that participation involves inherent and obvious risks including, but not limited to:
Strikes, kicks and impact contact
Throws and falls
Joint locks and restraint techniques
Grappling and ground fighting
Choking techniques
Accidental collision
Sprains, fractures, dislocations
Concussion or head injury
Aggravation of pre-existing injuries
Permanent disability or death
2.2 I understand these risks may arise from:
Physical exertion
Contact with instructors or participants
Equipment failure
Slippery or uneven surfaces
Negligence of myself or others
2.3 I voluntarily assume all such risks.
TC3. Australian Consumer Law – Limitation of Liability
WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012 (QUEENSLAND) AND THE AUSTRALIAN CONSUMER LAW
Under the Australian Consumer Law, several statutory guarantees apply to the supply of recreational services. These guarantees may be excluded in certain circumstances.
To the extent permitted by law, RealDefence excludes all liability for death or personal injury arising from the supply of recreational services.
If liability cannot be excluded, it is limited to the minimum extent permitted by law.
Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.
TC4. Release and Waiver
4.1 To the extent permitted by law, I release and discharge RealDefence, its directors, instructors, employees, volunteers and agents from liability for injury, loss or damage suffered as a result of participation in training.
4.2 This release does not apply to liability arising from reckless conduct or any liability that cannot be excluded under law.
TC5. Indemnity (Limited)
5.1 I agree to indemnify RealDefence for loss or damage caused by:
My negligence
My reckless conduct
My breach of these Terms
5.2 This indemnity does not apply to loss caused by RealDefence’s negligence or breach of law.
TC6. Medical Fitness and Disclosure
6.1 I declare that I (or my child) am medically and physically fit to participate.
6.2 I acknowledge the obligation to disclose any medical condition that may affect safe participation.
6.3 I understand RealDefence may refuse participation where safety is in question.
TC7. Online Training
7.1 For online training, I acknowledge that RealDefence cannot control my environment.
7.2 I accept responsibility for ensuring a safe training space free of hazards.
7.3 I assume all risks associated with training in my chosen location.
TC8. Children and Supervision
8.1 Parents/guardians consent to participation of minors.
8.2 Children are supervised only during their scheduled class.
8.3 RealDefence accepts no responsibility for unsupervised persons outside scheduled training.
TC9. Conduct
9.1 Participants must act lawfully and responsibly.
9.2 RealDefence reserves the right to terminate enrolment for unsafe or inappropriate conduct.
TC10. First Aid
10.1 I consent to first aid treatment within the qualifications of the attending officer.
10.2 Emergency services may be contacted where necessary.
TC11. Media Consent
11.1 RealDefence may capture photos or video for promotional purposes.
11.2 Written opt-out may be provided at any time.
11.3 Media will not be used in a manner that is misleading or inappropriate.
TC12. Privacy
12.1 RealDefence collects personal information for enrolment, communication and safety purposes.
12.2 Information is handled in accordance with the Privacy Act 1988.
12.3 Participants may request access or correction of their information.
12.4 A separate Privacy Policy is available upon request or on the website.
TC13. Membership and Payments
13.1 Fees are payable in advance.
13.2 Membership fees are non-refundable except where required by law.
13.3 Deferrals may be granted at the discretion of RealDefence.
13.4 Nothing in this section limits rights under the Australian Consumer Law.
TC14. Governing Law
These Terms are governed by the laws of Queensland, Australia.
TC15. Severability
If any provision is found unenforceable, the remaining provisions continue in effect.
TC16. Entire Agreement
These Terms constitute the entire agreement between the participant and RealDefence.
MEDIA CONSENT & IMAGE USE NOTICE
MC1. Purpose of Media Collection
RealDefence Krav Maga (“RealDefence”) may take photographs and/or video recordings during training sessions, grading events, seminars, or promotional activities for the purposes of:
Promoting RealDefence programs
Marketing via website and social media
Showcasing training activities
Community engagement
Images may be used on platforms including (but not limited to):
Website
Social media (e.g., Facebook, Instagram, YouTube)
Printed promotional material
Digital advertising
MC2. Nature of Images Collected
Media may include:
Group training images
Action shots during drills
Class environment footage
Event coverage
We do not publish personal contact details with images.
MC3. Consent – Adults (18+)
By signing below, I consent to RealDefence capturing and using images or video of me for the purposes listed above.
I understand:
I will not receive payment or compensation.
Images may be edited for formatting but not used in a misleading way.
I may withdraw consent at any time in writing.
If I withdraw consent, RealDefence will:
Cease future use; and
Remove or blur identifiable images from online platforms within a reasonable timeframe where practicable.
MC4. Consent – Children & Teens (Under 18)
If registering a minor:
I am the parent or legal guardian.
I consent to images/video being taken of my child for the purposes listed.
I understand images will not be used in a manner that is exploitative, inappropriate, or identifying beyond first name (if used at all).
RealDefence commits to:
Avoid identifying children with full names.
Avoid tagging child profiles.
Avoid publishing school names or location details that compromise safety.
Monitor and moderate comments where practicable.
Parents/guardians may withdraw consent at any time in writing.
MC5. Opt-Out / Blur / Removal Requests
RealDefence respects individual privacy preferences.
You may:

☐ Request face blurring in published content
☐ Request no images of you/your child be used
☐ Withdraw previous consent at any time

Upon request, RealDefence will:
Cease new publication
Remove or blur online content within a reasonable timeframe (where technically practicable)
Not be responsible for third-party sharing beyond its control (e.g., public reposting)
MC6. Storage & Privacy
Images and video recordings are:
Stored securely
Accessible only to authorised personnel
Managed in accordance with the Privacy Act 1988
Handled in accordance with RealDefence’s Privacy Policy
If cloud storage or social media platforms are used, data may be stored on servers located outside Australia.
MC7. No Obligation to Participate
Participation in media capture is voluntary.
Choosing not to consent:
Will not affect enrolment
Will not affect training opportunities
Will not result in disadvantage
MC8. Withdrawal of Consent
Consent may be withdrawn at any time by written notice. Withdrawal applies prospectively and does not affect lawful use prior to withdrawal.
